zifzi has a no tolerance spam policy. Constant Contact's customer support actively monitors large import lists and emails going to a large number of contacts. Any customer found to be using Constant Contact for spam will be immediately cut-off from use of the product. If you know of or suspect any violators, please notify us immediately at

Every email contains a mandatory unsubscribe link - those individuals who try to remove this link will be warned that they are doing so. If the link is removed or de-activated in any way, Constant Contact will terminate the customer's account.

What is Spam?
Spam is unsolicited email also known as UCE (Unsolicited Commercial Email). By sending email to only to those who have requested to receive it, you are following accepted permission-based email guidelines.

What constitutes a Preexisting business relationship?

The recipient of your email has made a purchase, requested information, responded to a questionnaire or a survey, or had offline contact with you.

What constitutes consent?

The recipient of your email has been clearly and fully notified of the collection and use of his email address and has consented prior to such collection and use. This is often called informed consent.

Isn't there a law against sending Spam?

The federal anti-spam law went into effect on January 1st, 2004 and preempts all state laws. While this new law will not stop spam, it does make most spam illegal and ultimately less attractive to spammers. The law is specific about requirements to send commercial email and empowers the federal government to enforce the law. The penalties can include a fine and/or imprisonment for up to 5 years.

How Constant Contact protects you from sending spam

Constant Contact is a permission-based email-marketing tool that follows the strictest permission-based philosophies:

Communication - Your Constant Contact registration page already states why you are collecting the site visitor's email address, how you plan to use their address, and that you are following the embedded privacy policy. Additionally, by accepting our license agreement you have agreed to use only permission-based lists and never to sell or rent your lists.

Verification - Constant Contact automatically sends all of your new contacts an email confirming their interest in receiving emails from you. Additionally, if your contact changes his or her interests or unsubscribes, Constant Contact automatically sends an email confirmation.

Unsubscribe - Every email generated from Constant Contact contains an unsubscribe link which allows your contacts to opt-out of future emails and automatically updates your contact lists to avoid the chance of sending unwanted emails to visitors who have unsubscribed.

Identification - Your email header information is correct because it is pre-set for you by Constant Contact. Your email's "From" address is verified and already accurately identifies you as the sender.

Contact Information - all of your emails are pre-filled with your contact information including your physical address.

How to protect yourself from Spam: Take the Spam Test

Are you importing a purchased list of ANY kind?

Are you sending to non-specific addresses such as: or other general addresses.

Are you sending to distribution lists or mailing lists which send indirectly to a variety of email addresses?

Are you mailing to anyone who has not explicitly agreed to join your mailing list?

Have you falsified your originating address or transmission path information?

Have you used a third party email address or domain name without their permission?

Does your email's subject line contain false or misleading information?

Does your email fail to provide a working link to unsubscribe?

Are you failing to process any unsubscribe requests that come to you via a reply to your email within 15 days or the request?

The Information We Collect and How We Use It

zifzi is committed to consumer privacy. By using our Web site and our service, participants consented to the collection and use of information by zifzi as detailed below.

Contact Information: When participants apply or register on our Web site, we ask for personally identifying information such as name and email address. We may find it necessary to use the contact information to inform participants of updates, about transactions or account information, or to provide customer support.

Personal Profile: During the registration process we ask for demographic profile and preferences regarding the types of marketing information the participant would like to receive. We personalize zifzi ads, messages, and zifzi Web pages by storing preference settings and profiles so the participant can control the promotions, special offers, newsletters, updates and other information received from us. These personal settings are maintained for the participant's benefit and will not be shared with third parties except in the ways explained below.

Wireless Identification Information: In order to deliver ads and messages to the wireless phone or device, we access some wireless identifying information. In addition, we may occasionally place a telephone call to the wireless phone number, but only if it's necessary to provide customer service.

Financial Information: If the participant chooses to take advantage of making purchases with the wireless phone or device, we ask for credit card number, expiration date and billing address, so that our systems can process whatever purchases or transactions are made.

Credit Approval Information: When applying for offers that require a credit check, such as a free wireless phone, we may ask for Social Security number, birth date, driver's license number, or credit card number. This information is sent to a wireless service provider to obtain credit approval. Every time a credit card number or other personally identifying information is entered, we encrypt it using Secure Socket Layer (SSL) technology. SSL protects information as it crosses the Internet.

Web Site and Wireless Tracking Information: We're always looking to improve our delivery of services to participants. And to do so we may track purchasing history as well as any advertisement or product searches and saves that are made through the wireless phone or device or our Web site. The terms and conditions of this Privacy Policy govern this information.

Internet Protocol Address: zifzi automatically receives and records information on our server logs from the browser including the IP (Internet Protocol) address and the specific Web pages requested. We use this information to help diagnose problems with our server and to better administer our Web site.

Information Sharing and Disclosure

zifzi will never sell or rent personally identifiable information to anyone.

The only time zifzi will send personally identifiable information to others is when:

» The participant has given consent to share the information;

» We need to share information to provide a product or service requested. This may include sending personally identifiable information to the third party from whom we are requesting the product or service on the participant's behalf and/or their agent or representative.

» We need to send the information to companies who work on behalf of zifzi. Third Party Providers: zifzi will provide ads, messages and Web site links to and from third parties in the course of providing our service. zifzi is not responsible for the privacy policies or practices of third party providers. Aggregate Information: Aggregate information is simply generic information about Web site traffic, other Web site and wireless device information, registration status, sales, saved searches, transactions and users of our Web site and zifzi services from which any and all personal or individually identifiable information has been removed. We may share, sell or otherwise make available such aggregate information to third parties, including our current partners. We may also buy or otherwise receive such aggregate information from such third parties.

Controlling Information

Profile and Personal Preferences: zifzi gives participants the ability to easily edit profile, credit card information (if applicable) and preferences at any time through personalized zifzi Web pages.

Opting-In: When participants choose to sign up for our service, that's called opting-in. zifzi is committed to permission-based, opt-in marketing - meaning, we only market to you if you say we can. When participants first opt-in, they provide some of the information described above. And later, through our communications with participants, we may offer them opportunities to obtain additional or enhanced services or products from zifzi or selected third parties. We may request additional personal or other information in order to obtain these additional or enhanced services or products. Any additional information that is provided to zifzi is subject to the terms of this Privacy Policy.

Opting-Out: As part of opting-in to the zifzi service, participants agree to the terms and conditions of the User Agreement, such as receiving a minimum of three advertisements per day on the wireless device. At any time participants may choose to opt-out of the program by contacting customer care at zifzi. If, in exchange for participation, participants were given free equipment or services, they may be billed for the cost of the equipment or services. Corrections/Updates: If any contact or other personal information changes or is incorrect, participants may access their personal profile and make the appropriate changes or send an email to with new or updated information.

Use of Cookies

Cookies: Our Web site may use cookies to enhance the consumer experience. Cookies are bits of information used for record-keeping purposes that are sometimes transferred to the participant's computer from our server. Once in place, cookies make web surfing easier by performing certain functions such as saving passwords and personal preferences on our Web site, and by ensuring that participants do not see the same ad repeatedly. Many consider the use of cookies to be an industry standard.

When participants access their zifzi account, we use a secure server that encrypts all information input before it's sent to us. Personalized zifzi Web pages are password-protected for consumer privacy and security.

In addition, all of the information we collect is protected against unauthorized access using industry standard efforts (such as firewalls or secure sockets layer where appropriate) to safeguard the confidentiality of personally identifiable information.

Changes to this Privacy Policy

zifzi reserves the right to edit this policy from time to time. If we make substantial changes we will notify participants by posting a prominent announcement on our Web pages.
